Passanger Air Transportation Agreement

The provisions of this Agreement, hereinafter referred to as (“Agreement”), are subject to the Brazilian Civil Code (Law No. 10.406, dated January 10, 2002, and its amendments), the Brazilian Aeronautical Code (“CBA”) (Law No. 7.565, dated December 19, 1986), the 1999 Montreal Convention (as it pertains to international transportation), Law No. 8078/90 - Consumer Defense Law, its amendments and other applicable regulations that govern the air transportation provided by GOL LINHAS AÉREAS S.A., a corporation registered under CNPJ/MF 07.575.651/0001-59, headquartered at Praça Senador Salgado Filho, s/nº, Aeroporto Santos Dumont, Térreo, Área Pública, entre os eixos 46-48/O-P, Sala de Gerência – Back Office, CEP 20021-340, city and State of Rio de Janeiro, hereinafter referred to as ("GOL").

Definitions

  1. The flight ticket (itinerary receipt), whether paper or electronic, hereafter referred to as (“Ticket”), and the luggage claim stub, hereafter referred to as (“Stub”), are also covered by this Agreement.
  2. The terms “Passenger” and “Passengers” refer to the users of the air transportation services that are the subject of this Agreement.
  3. The term “ANAC Tag” refers to the information on the Ticket regarding available space between aircraft seats and the width of the seat, as per Decree 135, dated March 9, 2010, of the National Civil Aviation Agency (“ANAC”) or any law enacted to replace it.
  4. The term “GOL Sales Channels” refers to the following ticket sales channels: (i) The Internet, via the website www.voegol.com.br; (ii) Customer Service Center, at 0800 704 0465; (iii) Sales Center, at 0300 115 2121; (iv) mobile app and (v) any GOL Store.
  5. The acquisition of a Ticket by the Passenger implies expressed agreement to the terms of this Agreement and the specific fare regulations pertaining to the Ticket.
  1. Passenger obligations
    1. 1.1. Boarding. Passengers must check-in at least 60 (sixty) minutes before the scheduled boarding time for domestic flights, at least 120 (one hundred and twenty) minutes before the scheduled boarding time for international flights, and 180 (one hundred and eighty) minutes before the scheduled boarding time for flights destined for the United States.
    2. 1.2. Compliance with Crew Member Instructions. After boarding, the passenger must follow any specific directions given in writing, verbally or in any other form by the flight crew. It is hereby understood that the captain, crewmember responsible for the operation and safety of the aircraft, is authorized to:
      1. prevent the boarding of any Passenger who: a) is under the influence of alcohol or narcotics or any other addictive or psychoactive substance; b) is not properly attired or not wearing proper footwear;
      2. at his or her discretion, at the first stopover, order the deplaning of any Passenger who: a) fits in one of the situations described above; b) is a nuisance to other passengers during the flight; c) refuses to follow the instructions given by the crew; d) compromises the order and discipline aboard the aircraft; e) places at risk the safety of the aircraft;
      3. give warning and/or take any and all actions necessary to protect the aircraft and the people and luggage aboard.
    3. 1.3. Other Duties. In addition to the abovementioned requirements, the Passenger must also:
      1. when applicable and in accordance with the legislation in force, submit to GOL, at least 72 (seventy two) hours prior to boarding, the Medical Information Form (“MEDIF”), duly signed and filled out by the Passenger’s physician;
      2. bear all documents and comply with all the conditions necessary for the boarding and deplaning, including rules for obtaining visas, permissions and vaccines, in addition to any other that may be required or applied to;
      3. comply with the documentation rules for boarding and deplaning regarding unaccompanied minors and passengers with special needs;
      4. refrain from actions that may cause any risk, discomfort, distress or harm to other passengers or crew members;
      5. refrain from smoking aboard the aircraft, including electronic cigarettes and similar;
      6. not carry dangerous items in the luggage or in any other way, as per the terms set forth by applicable legislation;
      7. refrain from storing carry-on luggage in passageways or in areas that may hinder access to emergency exits or their use;
      8. refrain from carrying any luggage belonging to third parties or luggage whose content is unknown to him/her;
      9. keep all of his/her luggage with him/her at all times while in the passenger terminal and ensure that it is duly identified;
      10. bear all land transportation and lodging expenses incurred during normal overnight stopovers;
      11. abide by and respect the itinerary as purchased, with due regard for the order of the flights and the conditions set forth in the fare regulations. Combining multiple fares and segments under the same reservation constitutes a single itinerary that will be considered in its entirety for the purposes of changes, cancellations and refunds.
      12. submit to civil aviation security inspections conducted by the airport’s operator, under penalty of being denied access to the boarding area and aircraft.
      13. for the purpose of eventual confirmation of the regularity of purchases made through credit cards and/or the safety of data of the passengers and air ticket purchasers: (i) to carry, at the time of check-in, the credit card used for the purchase; (ii) in case of purchases made through credit cards of parents or guardians, present documentation proving affiliation, guardianship or family bond and; (iii) in case of purchases made by third parties, carry, at the time of check-in, a copy of the credit card used for the purchase accompanied by a copy of an identification document valid throughout the national territory of the holder of the credit card used to make the purchase, also providing, as requested, a contact telephone number of the credit card holder.
    4. 1.4. Weapons Shipped as Checked Luggage or Boarding of Passengers Carrying Firearms. Any passenger bearing a firearm with due authorization who intends to travel in a domestic flight must present himself at least 2 hours in advance, and to board with firearms, 40 minutes before flight closing time at the GOL service desk at the airport premises, carrying all relevant documentation in accordance with legislation in force to carry out security procedures. If the passenger does not present the necessary documentation in advance as established, this could entail non-permission to board with firearms. It is the responsibility of the public security agency at the airport to verify, approve, and release the passenger to board with firearms or, otherwise approve transport of the weapon as checked luggage. Weapons for sporting use shall be shipped as checked luggage and placed in a proper place in the aircraft hold. At the moment of landing, the passenger must present himself to the airport staff for restitution of the weapon and ammunition. In case of cancellation of flights, alternate flights and airport closure, the passenger who does not remain within the restricted areas must file another request for authorization to board with firearms.
      1. 1.4.1. Transportation of firearms in international flights is forbidden, unless otherwise provided through treaties, conventions and agreements between the Brazilian Government and the final flight destination country. The passenger may ship the weapon as checked luggage in an international flight upon authorization of the Army Command.
  2. Reservation and ticket
    1. 2.1. Transfers. The Ticket is personal and non-transferable and is intended for use only by the Passenger whose name is printed on it. The Ticket is also non-endorsable and shall be subject to applicable fare regulations, as per the terms set forth by GOL.
    2. 2.2. Passenger Information for the Reservation. The Passenger or his/her agents or representatives must correctly fill out the when making a reservation, as required.
      1. 2.2.1. Correction of eventual mistakes in the filling in of name, last name or agname of the Passenger may be requested by the Passenger via the Customer Service Center, Check-in Desk or GOL Stores, upon provision of the correct information, provided that the request is made before the check in times.
      2. 2.2.2. It is hereby understood that, for purposes of providing Passenger information when making a reservation, the terms “Son,” “Nephew,” “Grandson” and similar terms will be entered into the appropriate field and mandatorily preceded by a family name.
      3. 2.2.3. Costs may be incurred to correct the filling in of the passenger's name, surname or agname in case of international flights operated by partner airlines.
    3. 2.3. Reservation Confirmation. A reservation shall only be confirmed upon payment, and GOL reserves the right to suspend the confirmation of the ticket for the purpose of confirming the regularity of purchases made through credit cards.
    4. 2.4. Flight Changes. Should the Passenger request changes in the itinerary or original time of the flight, and it is possible to do so, the fare may be adjusted accordingly and a fee may be charged for the changes, as per fare regulations, at GOL’s discretion.
    5. 2.5. Flight Cancellations. Subject to no-show declaration, the Passenger may cancel a confirmed flight reservation until the scheduled departure time, upon payment of the applicable fee and according to the fare regulations pertinent to the ticket purchased. The cancellation request does not imply an automatic refund of the residual amount, and a specific refund shall be requested if the fare regulation so permits.
    6. 2.6. Validity Term of Ticket Credit. The credit related to the Ticket purchased and not used shall be valid for 1 (one) year as of its payment date.
    7. 2.7. Please note that when purchasing a Ticket with the above-mentioned credit, the purchase within the credit validity term must be subject to fare prices in force at the time of the new reservation, and the Passenger shall be required to pay any cost beyond that necessary at the time of contracting the transportation service, if necessary, and the fare and refund policy of the new ticket shall be applicable as per the terms of the Agreement and applicable legislation.
    8. Sole Paragraph - The issuance of new Tickets with the use of the aforementioned credit may be made in any of the GOL Sales Channels.
  3. No-show
    1. 3.1 If the Passenger is a no-show, a breach of contract fee will be deducted from the total value of the Passenger’s reservation, and the reservations for subsequent segments will be automatically cancelled. The residual amount, which will correspond to the total reservation amount minus the breach of contract fee, shall remain as a credit, until request for reschedule or refund within 1 (one) year as of the reservation payment date, and in the event of reschedule, the Passenger will bear any fare differences. It is hereby understood that the Passenger shall pay the applicable fee according to the fare regulations in effect at the time of purchase.
    2. Sole Paragraph - The above conditions shall not apply if the passenger informs, until the time originally contracted for the domestic flight, that he/she wishes to use the return leg.
  4. Refunds
    1. 4.1. Ticket refunds may be requested under the terms set forth by the applicable legislation, whereby the refund amount shall always be equivalent to the segments that have not been used by the Passenger minus any other applicable amounts, in compliance with current legislation and the fare regulations for the Ticket purchased.
    2. 4.2. The Passenger may choose, in lieu of a refund, to keep the residual amount of the Ticket as credit for a period of 1 (one) year as of the date the Ticket was purchased, provided that the Ticket was purchased directly from GOL.
    3. 4.3. In the case that an itinerary is interrupted at a stopover airport intentionally by the Passenger or because the Passenger was expelled from the aircraft for not complying with the terms set forth in item 1.2 above, the passenger will not be entitled to a refund.
    4. 4.4. The reimbursement, upon request of the passenger, may be made in credits for the purchase of airfare. The credits arising from the cancellation of the air ticket may be used for the purchase of air tickets for third parties.
  5. Standby lists
    1. 5.1. Standby Lists. GOL may create standby lists at airports whenever the total number of confirmed reservations reaches the number of seats available on the aircraft. Passengers on the stand-by list will be called by the order his or her name appears on the list, in compliance with the priorities provided by law, according to the number of seats made available by no-shows passengers with reservations at the scheduled boarding time.
    2. 5.2. GOL does not accept any responsibility nor provide any guarantee that Passengers on the standby list will board a flight.
  6. LUGGAGE
    1. 6.1. Checked Luggage Allowance. For domestic and international flights operated by GOL, Passengers may check bags for a fee or according to the checked luggage allowance previously established by the fare rules applicable at the moment of purchase.
      1. 6.1.1. Children under 2 (two) years of age are not entitled to a luggage allowance unless a seat has been purchased for them.
      2. 6.1.2. The luggage allowance does not apply to the transportation of live animals, and such transportation is subject to specific fare policies.
    2. 6.2. Excess Luggage. Luggage that exceeds the luggage allowance permitted and/or acquired will be considered excess luggage and may be checked, at GOL’s discretion, subject to applicable fees, according to the terms set forth by GOL and current legislation.
      1. 6.2.1. The amount to be paid for excess luggage may vary between international flights, and such amounts may be verified at GOL website at the time of purchase.
    3. 6.3. Carry-on Luggage Allowance. Passengers may carry, at their sole and total responsibility, one single carryon bag, such as a backpack or a small suitcase, free of charge, provided the item complies with all the following requirements:
      1. the total weight must not exceed 10 (ten) kg and the dimensions must not exceed 55 (fifty-five) cm in height, 40 (forty) cm in length or 25 (twenty-five) cm in width.
      2. the objects contained in the carryon luggage must be properly packed;
      3. the carry-on luggage must fit inside the Passenger cabin without compromising the comfort and peace of the other Passengers and must not risk the physical integrity of the other Passengers, the crew and the aircraft.
      1. 6.3.1. Before boarding the aircraft, the Passenger should check with GOL as to which items the airline recommends transporting as carry-on luggage.
      2. 6.3.2. GOL may restrict the weight and contents of carry-on luggage for reasons of safety or aircraft capacity so that in the event of overweight compartments, luggage may be checked in the aircraft holds.
        1. 6.3.2.1. In the above case, if the Passenger arrives at the boarding gate of his flight with a non-standard carry-on luggage above, GOL reserves the right to make the dispatch of said luggage in the cargo hold of the aircraft, and it may charge for the luggage allowance.
      3. 6.3.3. Carry-on luggage requirements on international flights may differ from the requirements set forth in item 6.3, due to specific regulations or international agreements. Passengers should previously consult with GOL to learn about applicable requirements.
    4. 6.4. Transporting Animals. The transportation of animals is subject to the express authorization by GOL and payment of specific fees.
      1. 6.4.1. In order to transport any animal, the Passenger must present the required documentation described on the GOL website, upon boarding.
      2. Sole Paragraph - The presentation of the documents required by GOL does not guarantee that GOL will approve the transportation of the animal.
      3. 6.4.2. The transportation of a guide dog, trained to lead a visually impaired person, who is entirely dependent on it, shall be permitted in the passenger cabin, in addition to the luggage allowance and free of payment, provided that the documentation provided in item 6.4.1 above is submitted.
    5. 6.5. Prohibited materials and substances. Luggage, whether checked or carryon, may not contain under any circumstances:
      1. alarm devices;
      2. explosives, including empty cartridges, ammunition, pyrotechnical materials, hunting rifles, handguns or fireworks;
      3. gases (flammable, non-flammable and poisonous) such as butane gas, oxygen, propane, oxygen cylinders, etc.;
      4. liquids used as lighter fluid, fuel for heating purposes or any other application;
      5. flammable solids such as matches and items that are easily ignited;
      6. substances that could combust spontaneously;
      7. substances that, when placed in contact with water, release flammable gases;
      8. oxidizing materials such as powdered lime, bleaching agents and peroxides;
      9. poisonous (toxic) and infectious substances, such as arsenic, cyanides, insecticides and defoliants;
      10. radioactive materials;
      11. corrosive materials such as mercury, acids, alkalis and wet cell batteries, except when such batteries are being used to power motorized wheelchairs;
      12. magnetic materials or anything similar;
      13. weapons, ammunition, hunting rifles, handguns, unless permitted by applicable legislation;
      14. biological agents such as bacteria, viruses, fungi, etc.
      15. items or packages received from third parties or of unknown origin to the passenger;
      16. incapacitating substances such as pepper spray, tear gas or similar substances;
      17. electroshock weapons;
      18. suitcases, boxes or security-type attaché cases incorporating pyrotechnic material and/or lithium batteries;
      19. underwater lighting and welding equipment.
      20. lithium batteries;
      21. work tools such as hammers, crowbar, picks, etc.
    6. 6.5.1. This abovementioned list of materials and substances is not all inclusive and may be changed and/or amended at any time by GOL and/or according to specific regulations, without GOL having to inform the Passenger about such change and/or amendment. For further information, consult GOL.
    7. 6.5.2. Any of the materials and substances listed above, as well as any other prohibited materials or substances, may be removed at any time from the aircraft by GOL, at its discretion, whereby GOL shall be exempt from any liability, under any title.
    8. Sole Paragraph – In such cases, the Passenger shall be obliged to indemnify GOL for any costs incurred by the latter when removing or transporting such prohibited materials or substances, as well as for any damages that GOL or third parties may suffer as a result of such materials or substances.
    9. 6.6. Complaints – Damage to Luggage. In the event that the Passenger finds that there has been a violation or damage to the luggage, it shall request the filing of a Luggage Irregularity Record ("RIB") with a GOL representative at the airport within 7 (seven) consecutive days counted from the receipt of the luggage.
    10. Sole Paragraph - In case of damage to the luggage, the Passenger must carry the damaged luggage for analysis of GOL at the airport.
    11. 6.7. Loss of Luggage. If luggage is lost, the Passenger must immediately present such complaint to GOL, filing a Luggage Irregularity Report (“RIB), whereby GOL shall have the right to return the lost luggage within 7 (seven) days as of the complaint date in case of national flights and 21 (twenty-one) days in case of international flights.
      1. 6.7.1. If the luggage is not returned as per the abovementioned terms, then:
        1. GOL is liable for losses sustained due to destruction, loss or damage of the checked luggage, provided that such losses were incurred during the performance of the transportation agreement, whereby compensation shall be limited to the amount set forth in the applicable legislation, at the moment of payment, related to each Passenger, under the terms provided for in CBA, resolutions published by the National Civil Aviation Agency of Brazil and any future amendments thereto.
        2. GOL shall not be liable for any destruction, loss or damage of luggage exclusively resulting from one or more of the following factors:
          1. a) The inherent nature or a defect of the luggage;
          2. b) Improper packing of the luggage by the Passenger or by third parties who were requested to pack it by the passenger;
          3. c) An act of war or an armed conflict;
          4. d) An act of public authority with jurisdiction over the luggage;
          5. e) An Act of God or force majeure event;
          6. f) Damages caused by fault or negligence on the part of the Passenger.
          7. g) Other provisions set forth in clause 6.9 below.
    12. 6.8. Codeshare and Interline Agreements. The luggage allowance on Codeshare or Interline flights may differ from the luggage allowances set forth in item 6.1, due to specific regulations. Passengers should request information about luggage allowance from the party that sold the Ticket, prior to their flight.
    13. 6.9. Fragile Items and Damage Due to Use. GOL shall not be liable for any damage to fragile items carried or checked by Passenger such as, but not limited to, musical instruments, bottles and perfumes, sporting goods such as surfboards, windsurfing , skateboard, bike, golf equipment, kayak, diving and fishing equipment, ski, snowboard, camping tent and the like, electronic equipment including games, cell phones, tablets, notebooks and related items, handicrafts, art, sculpture or painting, automotive parts, styrofoam, cardboard or wood boxes, antiques, relics, collectibles and religious items, business equipment and samples, glass, ceramics, porcelain and mirrors, items dispatched in bags, plastic bags or paper bags that do not have sufficient resistance for the transportation and protection of its contents, jewelry, keys, medicines and medical equipment, except for assistance equipment, money, bank cards, checkbooks and personal documents, photographic equipment such as cameras, videos, audio and related items, contact lenses, glasses, sunglasses, hand or battery tools, boxes and containers for tools, individually and unguarded items such as umbrella, banner, sword, table and household items in general, items attached to the outside of the luggage, watches. GOL will not be liable for damage to luggage resulting from wear and tear, and it is understood that GOL will not repair or replace luggage in the events of scratches, abrasions, superficial dirt, missing zipper slider, damage to the support studs, damage to the logo, small holes, tears or dents, damage, lack or loss of padlocks and protective cover, lack of accessories such as shoulder straps, tags or similar.
    14. 6.10. Emergency Expenses. In case of loss of luggage, GOL will reimburse the Passenger who is away from home and make purchases of basic products such as clothes, shoes and toiletries. The initial indemnity, limited to the maximum amount of R$ 100.00 (one hundred reais) in Brazil and US$ 50.00 (fifty dollars) abroad, may be requested by the passenger after the opening of the Luggage Irregularity Record 24 hours upon presentation of invoices and provided that the luggage remains in a situation of loss. After 24 hours of the request for the first indemnity, and for each subsequent night, an indemnity will be due in the maximum amount of R$ 25.00 (twenty five reais) in Brazil and US$ 25.00 (twenty five dollars) abroad, limited to maximum value, including the first indemnity, of R$ 225.00 (two hundred and twenty-five reais) in Brazil, and US$ 175.00 (one hundred and seventy-five dollars) abroad, and provided that the luggage remains lost.
      1. 6.10.1 The request for reimbursement of emergency expenses may be made within 30 (thirty) calendar days from the filing of the Luggage Irregularity Record for cases in which the luggage has been found. In the event of a definitive loss, the Passenger must request the reimbursement of emergency expenses within a maximum of 8 (eight) calendar days from the filing of the Luggage Irregularity Record.
      2. 6.10.2 If the luggage is not found within 7 (seven) calendar days after the filing of the Luggage Irregularity Record, the amounts paid as emergency expenses shall be deducted from the amounts paid as final indemnity.
    15. 6.11. Declared Luggage. The Passenger may declare the value of dispatched items that exceed the amount of 1.131 Special Drawing Rights (DES), by completing a form provided by GOL, which must be filled in two copies and provided that the value of the items does not exceed R$ 15,000,00 (fifteen thousand reais). At its discretion, GOL may evaluate the items to which the Passenger may declare. For cases where the Passenger declares the amount dispatched, an amount for the acceptance will be charged from the Passenger, pro rata the value of the goods declared, in the terms established by GOL and in accordance with the current legislation.
      1. 6.11.1 In the event that the Passenger does not declare the value of the goods that are included in item 6.11, any indemnities will be limited to the maximum value of 1.131 Special Drawing Rights (DES).
      2. 6.11.2 Items such as cash, checkbooks, bank documents, credit titles, bank or credit cards, contact lenses, sunglasses, orthodontic appliances, jewelry, watches, photographic equipment commercial equipment, computer and software equipment, electronic equipment, tablets, cell phones, fragile items, vital medication, negotiable papers, keys, personal or commercial documents, works of art, items of sentimental or inestimable value, and other items of value shall not be accepted as declared luggage. Such items must be carried as carry-on luggage and kept under the control, surveillance and liability of the Passenger, subject to the limits established in item 6.3 or otherwise dispatched as air cargo. Goods and luggage whose value exceeds the amount of R$ 15,000.00 (fifteen thousand reais) will also be dispatched as air cargo.
      3. 6.11.3 Should there be any pre-existing damage to the luggage (eg. small cuts, scratches and broken zippers) as a result of natural wear, improper transportation, and poor accommodation of items in the luggage, no compensation will be due to the Passenger.
      4. 6.11.4 The special declaration may only be made on flights operated exclusively by GOL. If the itinerary includes flights operated by other airlines, even if with GOL numbering, the Passenger cannot make the declaration of his/her luggage.
  7. Cancellations and delays
    1. 7.1. Failure to Board. If a Passenger with a confirmed reservation is denied boarding after check in because of technical irregularities, operational security or overbooking, GOL shall offer the Passenger the options set forth by the applicable legislation.
    2. 7.2. Weather Conditions. If a flight is cancelled and/or delayed due to weather conditions, GOL shall offer the Passenger the options set forth by the applicable legislation, nevertheless, the contractual terms regarding the transportation of the Passenger shall remain unaffected once the appropriate Agency has authorized the departure of the flight.
    3. 7.3. Missed Connections. GOL shall not be liable for missed connections caused by flights operated by other airlines, except for Codeshare flights. Likewise, GOL shall not be liable for missed connections caused by reservations made by third parties that do not allow for enough time between flights to make the connection.
    4. 7.4. Connections Scheduled by Passengers. It is hereby established that connections scheduled by Passengers on flights that are not offered by GOL are the responsibility of the Passenger. The Passenger must claim his/her luggage and check in for the subsequent flight(s) at the scheduled time(s). GOL shall not be liable if the Passenger fails to make the subsequent check-in(s) at the scheduled time.
  8. Interline agreements
    1. 8.1. Interline agreements allow GOL to sell segments operated by other carriers whose flights are identified by the codes of the operating carrier. When GOL sells an Interline ticket (which includes flights operated by partner airlines) it is acting as a ticket issuing agent and it shall not be liable for the acts or omissions by such airline. GOL shall be solely liable for the flights operates by its own aircrafts.
    2. 8.2. Acceptance of Interline Tickets Issued by Other Airlines. Tickets issued by other airlines shall be accepted, provided that the airlines have an Interline agreement with GOL and are in compliance with their contractual obligations. Any and all refunds or reimbursements of such tickets shall be made by the airline that issued the ticket.
  9. Codeshare
    1. 9.1. Codesharing is a practice that allows an airline to sell or offer seats on flights operated by a partner airline as if they were its own. Thus, a flight can be sold with the “G3” designator code, but may be operated by a GOL partner airline. Whenever a segment offered by GOL is operated by a partner airline under a codeshare agreement, the Passenger shall be duly informed at the time of the selection of such segment.
    2. 9.2. Applicability of Codeshare Services. One or more flight segment on the Passenger’s itinerary may be operated by carriers other than GOL. However, if the Passenger purchases a GOL ticket, this Agreement will be applicable regardless of the operating carrier. GOL accepts responsibility for the entirety of the codeshare segments according to the terms of this Agreement, provided the flight designator code is “G3.”
    3. 9.3. Rules Applicable to Codeshare Flights. Notwithstanding any other provisions of this Agreement, the following rules will apply to flights operated by GOL Codeshare partners:
      1. 9.3.1. Luggage. For itineraries in which at least one segment is operated by a GOL Codeshare partner, each Passenger shall be entitled to the luggage allowance of the carrier that issued the ticket and shall be charged for excess luggage, when applicable, by the carrier operating the flight. If necessary due to operational or security reasons, the operating carrier may require carry-on luggage to be checked at the boarding gate, and an excess luggage fee may be charged, if applicable
      2. 9.3.2. Unaccompanied Minors. Consult rules applicable by GOL airlines partners for the transportation of unaccompanied minors.
      3. 9.3.3. Transporting Animals. It is hereby established that no animals will be permitted on Codeshare flights, except for service animals, not including, however, emotional support/assistance animals.
      4. 9.3.4. Transportation of Sports Equipment SPEQ). Consult rules applicable by GOL airlines partners for the transportation of sports equipment on Codeshare flights.
    4. 9.4. Additional Services Provided by GOL Partner Airlines. This Agreement does not mention eventual additional services offered by GOL Codeshare partners such as: (i) more checked luggage items; (ii) larger or heavier items; (iii) special luggage; (iv) additional carryon items (v) unaccompanied minors; (vi) animals in the cabin or aircraft hold; and (vii) later check-in times. GOL Codeshare partners may charge a fee for any additional discretionary services it provides. The Passenger may obtain additional information about these services from the operating carrier.
  10. Additional fees
    1. 10.1. Ground Transportation. Any and all ground transportation to and from the airport that is provided by GOL or third parties contracted by GOL may be charged for by GOL, at its discretion, and are not included in the price of the air transportation service.
    2. 10.2. Special Seats. GOL may sell special seats with more space and comfort to the Passenger during the reservation process, at its discretion, and such seats will be subject to the applicable fares.
    3. 10.3. Buy on Board. GOL may, on any of its flights, offer onboard shopping services at costs not included in the fare price, to be paid by the Passenger when using the service, at the Passenger’s discretion.
    4. 10.4. Insurance. GOL is authorized to offer, in addition to the fare price, transportation insurance or any other insurance that may be relevant to the needs of the Passenger.
    5. 10.5. Fare for unaccompanied minors under the age of twelve. GOL reserves the right to charge a fee for providing the extra services of escorting an unaccompanied minor under the age of 12 (twelve) from the boarding area to the aircraft and from the aircraft to the arrival area, when such services are requested by the person responsible for the child.
    6. 10.6. Other Services. If the accommodation of the Passenger requires extra seats, GOL may charge an additional fee equivalent to the number of additional seats occupied by the Passenger.
  11. GOL’s responsibilities
    1. 11.1. Responsibility. GOL shall only be held responsible according to the terms of this Agreement and to the extent permitted under applicable law.
      1. 11.1.1. GOL shall not be liable for damage caused to Passengers due to:
        1. death or injury resulting solely from the state of health of the passenger;
        2. an accident for which the Passenger is exclusively at fault;
        3. an Act of God or force majeure event.
      2. 11.1.2. GOL shall not be liable for damages caused by an Act of God or force majeure event or a determination by the air force authorities.
  12. Passenger’s Under Police Custody
    1. 12.1. Air transport of passengers under judicial and/or escorted conditions must be coordinated at least 48 (forty-eight) hours in advance between the Airport Police Authority, the local airport administration and GOL, establishing special security measures for boarding and the conduct to be taken on board the aircraft, ensuring that boarding and landings are always carried out discreetly.
    2. 12.2. A maximum of 2 (two) people under police custody may be transported on the same aircraft, with a minimum of 2 (two) officers escorting each person in custody.
    3. 12.3. The person in custody, under normal conditions, may not be handcuffed to any part of aircraft, including, but not limited to, seats and/or tables.
    4. 12.4. The Passenger under custody and their escorts shall not be served alcoholic or intoxicating beverages, nor will they be served meals with utensils that are metal and/or perforating.
    5. 12.5. Officers escorting passengers under custody may bring aboard equipment for restraining the passenger, if needed.
    6. 12.6. The escorting officers may not bring aboard nightsticks, tear gas or any other incapacitating gas. Any firearms brought aboard must comply with the provisions detailed in item 1.4 of this agreement.
    7. 12.7. The person or institution in charge of escorting the passenger must provide assurances to GOL that the person under custody does not bear any prohibited items, as per ANAC’s Resolution No. 207 or any law that comes to replace it.
    8. 12.8. The risk posed by the person in custody must be assessed by the relevant law-enforcement authority prior to the individual being transported on a commercial flight, given that GOL may prevent the person in custody from boarding the aircraft if it deems the person represents a risk to the flight and other passengers.
  13. General regulations
    1. 13.1. Specifications of the ANAC Tag. It is hereby established that the information on the ANAC Tag may be changed for operational reasons at any time prior to boarding.
    2. 13.2. Seat Specifications. It is also hereby established that seats reserved by Passengers may be changed by GOL for operational reasons at any time prior to boarding, at GOL’s discretion.
    3. 13.3. Transportation Agreement. A copy of this Agreement is available at GOL’s stores and website and will be provided upon request.
    4. 13.4. Information regarding passengers traveling abroad, that are known by or under possession of GOL, may be submitted to a national/international customs agency and/or a national/international security body, by force of a legal obligation or contract signed between the Brazilian Government and a legal representative of the Passenger’s country of destination.
  14. Applicable legislation and forum
    1. 14.1. This Agreement shall be governed according to Brazilian legislation. Any dispute arising out of or in connection with this Agreement shall be settled via the forum of the district of São Paulo.
  15. Validity
    1. 15.1. This Agreement shall take effect on October 29, 2018, and all previous provisions are hereby annulled in totum.
